L'identité au XXIe siècle. Étude de droit comparé entre la France et le Québec. // Identity in the 21st Century: A Comparative Legal Study of France and Quebec.

Le présent projet de recherche a pour objet principal d'analyser de façon approfondie la notion d'identité en ce début de XXIe siècle, à travers le prisme des droits français et québécois, ainsi que de leurs évolutions récentes et croisées.

La notion d'identité, située au cœur de nombreux débats sociétaux contemporains, suscite en effet de vives controverses des deux côtés de l'Atlantique. Ces controverses tiennent notamment à des revendications relatives au changement de sexe ou de genre des individus, à l'établissement de nouvelles formes de filiation, ou aux nouvelles interrogations soulevées par l'émergence d'une identité numérique et d'une identité des personnes non-humaines (relative aux animaux en particulier, à la Nature en général, ou encore au robots).

A cet égard, la notion d'identité se trouve traversée par des injonctions contradictoires. D'un côté, des impératifs d'ordre politique et juridique continuent d'imposer une identification stricte des personnes, gouvernée par un principe d'immutabilité de l'identité. Or d'un autre côté, de nouveaux impératifs d'ordre social et environnemental exigent la prise en considération de nouvelles revendications, tant individuelles que collectives. Ces revendications incluent, entre autres, la reconnaissance des diverses orientations personnelles des individus et la reconnaissance de droits à la Nature.

Dans ce contexte, le présent projet se propose d'adopter une démarche de droit comparé afin de porter un regard nouveau sur la notion d'identité et les règles la régissant.

L'objectif final est de proposer des réponses claires, cohérentes et efficaces aux immenses défis que traverse cette notion.

The main aim of this research project is to conduct an in-depth analysis of the concept of identity at the start of the 21st century, through the lens of French and Quebec law, as well as their recent and intersecting developments.

The concept of identity, which lies at the heart of many contemporary societal debates, is indeed the subject of fierce controversy on both sides of the Atlantic. These controversies relate in particular to claims concerning individuals' changes of sex or gender, the establishment of new forms of parentage, or the new questions raised by the emergence of a digital identity and the identity of non-human persons (relating to animals in particular, to Nature in general, or even to robots).

In this regard, the concept of identity is subject to conflicting demands. On the one hand, political and legal imperatives continue to impose a strict identification of individuals, governed by the principle of the immutability of identity. On the other hand, however, new social and environmental imperatives demand that new claims, both individual and collective, be taken into account. These claims include, amongst other things, the recognition of individuals' diverse personal orientations and the recognition of rights for Nature.

Against this backdrop, this project aims to adopt a comparative law approach in order to take a fresh look at the concept of identity and the rules governing it. The ultimate objective is to propose clear, coherent and effective responses to the immense challenges facing this concept.
