L'association conjugale. Contribution à l'étude d'un droit patrimonial du couple en affaires. // The Marital Partnership. A Contribution to the Study of Property Rights for Couples in Business.

Être partenaire ou associé en affaire quand on est un couple : voilà ce que se propose d'étudier ce sujet de thèse sur « l'association conjugale ». L'association conjugale, expression dont la thèse examinera la valeur heuristique, consiste à doubler la communauté de vie d'une communauté d'intérêts autour d'une entreprise ou d'un projet patrimonial nécessitant des investissements en capitaux ou en industrie de la part des deux membres du couple.
En ce sens, le terme d' « association » choisi pour le titre, relève non seulement d'un rapport entre associés mais de tout lien économique lié à une entreprise commune quelle qu'en soit la forme juridique : sociétés civiles (SCI…) ou commerciales, investissements dans un patrimoine immobilier, produits d'épargne... Quant à la conjugalité, elle s'exprime au sens propre autour du rapport du couple marié mais aussi des autres formes de vie de couple (concubinage et PACS).
L'intérêt de ce sujet est de renouveler l'approche juridique du couple dans les affaires en lien avec la pratique, notamment notariale en examinant les interactions entre le droit de la famille et le droit des affaires. La dissolution du couple par séparation ou par décès constitue une césure dont il conviendra de traiter les effets juridiques dans la famille et en dehors de celle-ci.

Being a partner or associate in business when you are a couple: this is what this project proposes to study. The association, an expression whose heuristic value the thesis will examine, consists in examining the community of life of a community of interests around a company or a patrimonial project requiring investments in capital or in industry on behalf of the two members of the couple.
In this sense, the term 'association' chosen for the title refers not only to a relationship between partners but to any economic link related to a common enterprise, whatever its legal form: civil (SCI, etc.) or commercial companies, investments in real estate, savings products, etc. As for 'conjugality,' it is expressed in the literal sense in relation to the married couple but also in other forms of cohabitation (cohabitation and civil partnerships).
The value of this topic lies in renewing the legal approach to couples in business matters, particularly in the context of notarial practice, by examining the interactions between family law and business law. The dissolution of a couple through separation or death constitutes a rupture whose legal effects, both within and outside the family, must be addressed.
Furthermore, a broader reflection on the financial relationships within couples can help to better understand the economic stakes of married life as economic agents, where private and economic interests form a complex mixture of economic ties and legal relationships.
A comparative law approach (Italy-Switzerland) will be favored to highlight differences in the organization of financial flows related to capital appreciation, investment, or business activities within the couple.

Un excellent profil privatiste (master droit privé) est nécessaire pour ce sujet assez ambitieux. Il serait préférable d'avoir un ou une familialiste avec une dimension patrimoniale et de droit des affaires. Une appétence pour le droit comparé est également un plus.
A strong background in private law (Master's degree in private law) is required for this rather ambitious project. Ideally, the candidate should have a background in family law with a focus on estate planning and business law. An interest in comparative law is also a plus.
